Applicability of the policy

This Privacy Policy shall apply to the Information that the Company collects in furtherance to your access/use of the Platform and/or Services including but not limited to any Information you may submit to access the Platform and avail the Services in accordance with the Terms or e-mails that you exchange with the Company. This Information is necessary for the adequate performance of our obligations towards you and to allow us to comply with our legal obligations. Without this Information, we may not be able to provide you access to and allow the use of the Platform and the Services.

Nature of Information Collected and Manner of Collection

The Company or any third-party authorised by the Company may collect different types of information, via your use of the Platform, which is collectively hereinafter referred to as “Information”. This Information could be of the following types:

1. Account Information: information that you provide while creating an Account such as School name.
2. Personally Identifiable Information or PII: information that could be used to identify the Users including the admin such as name, age, email address, phone numbers, location, address, including any interaction with Users, and other similar information.
3. Non-Personal Information: information that cannot be used to identify you or the Users such as the School’s affiliation, the School’s domain, the School’s logo, class details, and/or any administrative information pertaining to the School or the Users (including the name of the school’s coordinator) and/or any social media profile URLs of the School (including those on Facebook, x.com and Linkedin), and/or any User information. .
4. Device Information: information which is automatically collected about the operating system or version of the system from which the Platform is used including browser information, remote IP address, locale.

You are responsible for ensuring the accuracy of any Information you submit to the Company in furtherance of your use or access to the Platform and/or the Services. Inaccurate Information may affect your ability to use the Platform and the Services that are provided to you.

You understand that the Information collected by the Company, or any third-party authorised by the Company, may be collected directly or through automatic tracking of the usage of the Platform through the use of cookies or other tracking technologies. The data automatically collected may include usage information such as details of your computing and/or communication device location, connections, or any information that the Company or any third-party authorised by the Company may collect. You may decline these cookies by changing your Platform settings. However, do note that this may impact the Services availed by you.

Use of Your Information

The Information collected from the Use of the Platform and the Services will be used for the following purposes:

1. To provide Platform and Services;
2. To make improvement to, and to customize, the Platform and the Services;
3. To provide the relevant Information to the Company’s partners, government and government agencies who have requested for it;
4. Internal purposes to understand the background of the Users of the Platform;
5. To correspond/communicate with the Users pursuant to Use of the Platform;
6. To provide you with information, Services and emails where you have consented to be contacted for such purposes;
7. To notify you about changes to the Platform, this Privacy Policy or the Terms;
8. To notify you about any change and improvements to the Platform and/or Services;
9. For analytical purposes, including but not limited to assessing usage data, usage patterns and other similar activities to evaluate the Platform and/or the Services;
10. In any other manner which we may describe when you provide the Information.

Except as otherwise provided herein, no PII will be stored, published, disclosed or shared with any third party without your express consent.

Please do not include or submit any PII unless specifically requested by the Company. If the Company determines that any Information/content you have provided or uploaded violates the terms of this Privacy Policy, the Company has the right, in its absolute discretion, to delete or destroy such Information without incurring any liability to you.

Disclosure of Your information

We share Information about you with your consent for operating and maintaining the Platform and Services as follows:

1. For using the Product or Services
   We may share Information with other Users who need to know that Information.
2. For Customer Support
   We use your Information for our live chat functionality, which is used to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Platform and the Services.
3. For Legal Reasons
   The Company may also share Information with individuals or entities to the extent it believes in good faith it is required to:
   • ensure compliance with the law/ regulations and/or pursuant to enforceable orders of the government, law enforcement or regulatory authorities;
   • address fraud, security or technical issues;
   • protect against harm to the rights, property or safety of the Company, its other users or the public as required or permitted by law.
4. For Effective Provision of Services
   The Company may share your Information with Company employees, contractors and agents who need to know that Information in order to provide the Platform and Services to you and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.
5. To conduct Analytics
   We are always looking for ways to make our Platform and Services smarter, faster, secure, integrated, and useful to you. The Company uses collective learnings about how people use our Platform and Services, and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement of the Platform and Services.

Given the nature of internet transactions, the Company or third parties authorised by it under this Privacy Policy, cannot guarantee the security of such Information or take any responsibility for the transmission of Information on the internet because there is some risk that an unauthorized third party may find a way to circumvent its security systems or that transmission of your Information through the Platform may be intercepted. Any transmission of Information on the internet is done at your risk and the Company or such third party authorised by it under this Privacy Policy, shall not be responsible for the circumvention of the privacy or security settings either by you or any third party.

This Privacy Policy does not apply to, nor does the Company take any responsibility for, any Information that is collected by any third party either using the Platform or providing any related services including but not limited to payment services through an external platform.

We may disclose your Information to our agents, employees, advisors, service providers and affiliates who require the Information for the purposes of operating and maintaining the Platform and for facilitating your use of the Platform and availing the Services.

Data Retention and Data Deletion

The Company may retain Information, for such length of time as may be required, in order for the Company to provide you with the Services, comply with legal obligations, resolve any disputes that may arise, enforce its rights arising out of agreements with its Users, and/or for such period as may be required by legislations/orders of regulatory authorities to which the Company or such third party is subject to.

If you no longer want to use the Platform and the Services and want your Account/PII to be deleted, you may contact the Company at info@curioused.ai to request that your Account be deleted. Your Account and all your PII will be deleted within a period of thirty (30) days from the date on which you request deletion thereof. If you wish to access the Platform and avail the Services once your Account is deleted pursuant to your request, you will have to sign-up as a new user.

Rectification of Inaccurate or Incomplete Information

You can change, alter, modify, or delete your Account at any time by e-mailing us at info@curioused.ai. However, please note that in the event you alter, or update or delete your Account, we cannot ensure the availability and accessibility of the Platform or the continuity and/or quality of the Services being provided to you.

The Company may permit or deny modification of any Information, to the extent such Information is required by it in order to be compliant with and observe applicable laws. You have the right to ask us to correct inaccurate or incomplete PII concerning you (which you cannot update within your Account).

Data Security

The Information that you provide, subject to disclosure in accordance with this Privacy Policy and the Terms, shall be maintained in a safe and secure manner. The Information collected by the Company are stored on secure servers with appropriate firewalls that are either owned by the Company or by third parties.

While the Company will use all reasonable efforts to ensure that your Information is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable.

The Company complies with industry standard information security practices and is ISO27001 certified.

Complaints

If you wish to place a complaint with regard to privacy requirements or laws, access to any of your Information or would like to update or correct any errors in your Information, please contact our Data Protection Officer/Grievance Redressal Officer, at info@curioused.ai so that we can consider and respond to your request.

Compliance

You shall procure and during the Term and thereafter maintain all the necessary approvals with respect to any information or personally identifiable information provided by you or collected by us based on your instructions. You shall at all times comply with the applicable laws with respect to collection, sharing, processing of information including personally identifiable information.

Amendments to the Privacy Policy

This Privacy Policy is subject to change at the Company’s sole discretion. Any changes to the Privacy Policy will be communicated through the Platform or by email. School shall be responsible to inform the Users of any changes to the Privacy Policy. You are advised to review this Privacy Policy periodically for any changes.

This Privacy Policy shall form a part of the Terms.
